FOR WHAT PURPOSES AND ON WHAT LEGAL BASES DO WE USE YOUR DATA?

Talengo, S.A. will process the personal data obtained through the website for the following purposes:

  • To manage the CVs sent along with the corresponding electronic form completed by the interested parties by including them in the candidate database, under the responsibility of Talengo, S.A. The CVs included in such database will be processed to provide the candidate executive search service (headhunting). If a vacancy that matches your professional profile arises, TALENGO, S.A. will transfer your curricular data to the company interested in filling the vacancy. The recipient entity’s data will be communicated to you by email at the time such transfer is to take place. Likewise, we will also use your email account to keep you informed about the progress of the selection process.
  • To provide the service of consulting the candidate database to the franchises by Talengo, S.A. Such entities will use the consulted data to provide their own executive search/headhunting services within the territorial scope they have been assigned; that is, respectively, Colombia and Mexico. Legal basis: existence of express consent from the candidates for the transfer of their data to the franchises.
  • To adequately address the requests received through the “custom solutions” form. Legal basis: existence of legitimate interest and necessity for the execution of a pre-contractual relationship, if applicable.
  • To adequately address the requests for general information received through the “contact” form. Legal basis: existence of legitimate interest.
  • To manage the information obtained through the cookies used during your navigation, in accordance with our Cookie Policy. Legal basis: existence of express consent regarding non-exempt cookies.

DO WE SHARE YOUR PERSONAL DATA?

The personal data that Talengo, S.A. processes as Data Controller will be accessible to external auxiliary service providers contractually linked as Data Processors, such as hosting/hosting services, IT maintenance of management applications, cybersecurity services, external data protection officer (DPO), and legal advisors.

Furthermore, the CVs included in the candidate database that are preselected by Talengo, S.A. will be transferred to the companies that have contracted the services of executive search and pre-selection of candidates (headhunting) from this entity.

In the event that there is express consent for it, the CVs included in the candidate database may be transferred to the franchises of Talengo, S.A. Such transfer will be carried out through the database consultation service that Talengo, S.A. provides to its franchises for them to provide their business services in the corresponding territorial scope.

For these purposes, it is stated that the franchises by Talengo, S.A. currently are as follows:

Data may also be transferred to bodies and entities of the Public Administrations, as well as to lawyers, solicitors, prosecutors, courts, and tribunals, and law enforcement agencies when legally appropriate.

WHO IS RESPONSIBLE FOR PROCESSING YOUR PERSONAL DATA?

This website is hosted on servers located within the European Union, under the responsibility of Talengo, S.A.

To the extent that the services of Talengo, S.A. are requested/contracted by business organizations established in countries outside the European Economic Area, international transfers of personal data to such organizations may occur.

As indicated in the previous section, the franchised companies by Talengo, S.A. may consult the candidate database in order to provide their business services in their corresponding territorial scope, provided there is express consent from the interested parties.

In any case, the international transfers made by Talengo, S.A. will be guaranteed either by the existence of an adequacy decision or by the use of clauses in accordance with the Commission Implementing Decision (EU) 2021/914 of 4 June 2021 on standard contractual clauses for the transfer of personal data to third countries under Regulation (EU) 2016/679 of the European Parliament and of the Council. Only when it is not possible to rely on any of the legally provided safeguard instruments can international data transfers be based on one of the exceptions of Article 49 GDPR regarding specific situations.

FOR HOW LONG DO WE KEEP THE PERSONAL DATA OF USERS?

Talengo, S.A. will retain the personal data obtained through the website only for the time necessary in relation to the purposes linked to each processing, during the legally established period, if applicable; and as long as active statutes of limitations on legal actions, in accordance with current legislation.

The personal data linked to the CVs sent for inclusion in the candidate database managed by Talengo, S.A. as Data Controller will be retained as long as you do not revoke the consent granted or as long as the processing meets criteria of quality, integrity, and updating of professional data. In this regard, we would appreciate it if you could inform us of any relevant change affecting the content of your CV.

Notwithstanding this, at least every two years, Talengo, S.A. will contact the candidates included in the database for the purposes of updating, purification, and, where appropriate, renewal of consent for the processing of their curricular data.

Talengo, S.A. has the faculty to modify this personal data protection policy, to adapt it to legislative, doctrinal, or jurisprudential developments that are applicable, as well as for technical, operational, or commercial reasons, always within the legally established limits.

DISPUTE RESOLUTION

In general, any dispute that arises in relation to the processing of personal data will be attempted to be resolved amicably and with the advice of the designated DPO/DPO by Talengo.

However, it is informed that the data subject may resort to the Spanish Data Protection Agency (AEPD) or even to judicial proceedings if deemed appropriate, in accordance with Articles 77 and 78 GDPR.
